ARTi Terms of Service
These Terms of Service (the "Terms") govern your use of the ARTi mobile application and related services (the "Service") provided by E1 Technology Inc. ("ARTi", "we", "us"). Your use of the ARTi software is also governed by the End User License Agreement at /eula.
By creating an account or using the Service you agree to these Terms, our Privacy Policy, our EULA, and our Community Guidelines.
1. Eligibility and account
You must be at least 13 years old to use ARTi. Users between 13 and the local digital-consent age (16 in the EU under GDPR Art. 8 with national variations — for example, 14 in Spain) may only use the Service if a parent or legal guardian has reviewed and accepted these Terms on your behalf during registration.
You may only have one account per person. You are responsible for keeping your credentials secure and for all activity on your account. Notify us at support@arti.social if you suspect unauthorized use.
2. The Service
ARTi is a social learning platform where users explore topics by creating and sharing content — images, videos, infographics, games, fun facts, quizzes, and reflections — generated with AI assistance. The Service includes:
- Free content creation (Reflection, Fun Fact, Quiz, Glossary).
- Visual content creation that consumes Gems (Image, Infographic, Video, Game).
- A social feed, comments, likes, and projects.
- An optional premium subscription, ARTi+.
Features and pricing may change; we will give reasonable notice of material changes.
3. Subscriptions (ARTi+)
ARTi+ is offered through Apple's App Store as auto-renewing subscriptions:
- ARTi+ Monthly — USD 9.99 per month.
- ARTi+ Yearly — USD 89.99 per year.
Both plans include a 7-day free trial for eligible new subscribers.
- Payment is charged to your Apple ID at confirmation.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Cancel via iOS Settings → [your name] → Subscriptions → ARTi → Cancel Subscription.
- Deleting the app does not cancel your subscription.
- Refunds are administered by Apple in accordance with Apple Media Services Terms.
Local prices in non-USD currencies are displayed at the App Store and may include applicable taxes.
4. Gems
Gems are an in-app virtual currency used to create visual content and for premium actions like super-likes and streak freezes. Gems have no real-world monetary value, are non-transferable, and cannot be exchanged for cash. Gems balance is forfeit on account deletion or termination.
5. User-Generated Content
You retain ownership of the content you create on ARTi.
By posting or sharing content on ARTi, you grant E1 Technology Inc. a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for technical purposes such as resizing or formatting), display, and distribute that content on or through the Service.
You represent that:
- You have all rights necessary to grant the license above.
- Your content does not infringe any third-party rights.
- Your content complies with these Terms and the Community Guidelines.
We may remove, restrict, or refuse content at our discretion when it violates these Terms or the Community Guidelines, in response to a valid legal demand, or to protect users.
When we remove your content, we will notify you with the reason and your right to appeal. If a removal was triggered by a copyright claim, see Section 9 (DMCA).
6. AI-generated content
ARTi uses third-party AI services (currently Google Gemini, Imagen, Veo, and OpenAI) to generate visual content from your text prompts.
- You are responsible for the prompts you submit and the content you publish.
- AI output may contain inaccuracies, biases, or errors. Review your content before publishing.
- The legal status of AI-generated content is evolving. We make no guarantee that AI-generated output is free of third-party rights, and you may be subject to a valid copyright claim if generated content closely reproduces copyrighted material.
- AI output is subject to the applicable terms of the upstream AI providers.
7. Acceptable use
You will not, and will not encourage others to:
- Post sexual, violent, hateful, harassing, or illegal content (see Community Guidelines).
- Impersonate another person, user, or ARTi staff member.
- Circumvent moderation or safety systems.
- Collect personal information about other users.
- Use bots, scrapers, or automated agents.
- Reverse engineer, decompile, or otherwise tamper with the Service.
- Use the Service in violation of any applicable law.
Violations may result in content removal, warnings, suspension, or permanent termination, depending on severity and history.
8. Reporting and moderation
To report content or a user, long-press on any post, comment, or profile and select Report. Categories include Inappropriate Content, Harassment, Spam, and Copyright (DMCA). Our moderation team aims to act within 24 hours for high-risk reports and 72 hours for general reports. See the Community Guidelines for full policy.
9. Copyright (DMCA)
ARTi complies with the Digital Millennium Copyright Act. To submit a copyright infringement notice, see our DMCA page or write to dmca@arti.social.
We will:
- Promptly remove or disable access to content identified in a valid takedown notice.
- Notify the user whose content was removed.
- Offer the user an opportunity to submit a counter-notice.
- Terminate accounts of repeat infringers.
10. Termination
You may delete your account at any time via Profile → Settings → Delete Account, or by writing to support@arti.social. Deletion is permanent and forfeits Gems, points, and streaks.
We may suspend or terminate your account, with or without notice, if you breach these Terms, the Community Guidelines, or the EULA, or where required by law. After termination, sections 5 (license to content already posted), 6 (AI), 11 (warranties), 12 (liability), 14 (governing law), and 15 (general) survive.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot be disclaimed under applicable law.
ARTi does not guarantee that the Service will be uninterrupted or error-free, that AI output will be accurate or non-infringing, or that user-generated content will be free of objectionable material.
12. Limitation of liability
To the maximum extent permitted by law, E1 Technology Inc. and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to the Service.
Our total aggregate liability for any claim arising from these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100. Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the smallest amount permitted by law.
13. Indemnification
You agree to indemnify and hold harmless E1 Technology Inc. and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising out of (i) your content, (ii) your breach of these Terms or the Community Guidelines, or (iii) your violation of any third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Subject to applicable consumer protection laws in your country of residence:
- Any dispute arising from or related to these Terms or the Service must be brought in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction there.
- For users in the EU, UK, Mexico, Colombia, or other jurisdictions whose mandatory consumer law applies, you may also bring proceedings in your local courts and benefit from your local consumer protections.
15. Apple-specific terms
If you obtain ARTi through the Apple App Store, the following also apply:
- These Terms are between you and E1 Technology Inc., not with Apple. Apple is not responsible for the Service.
- Apple has no obligation to provide maintenance or support for the Service.
- In the event the Service fails to conform to any applicable warranty, you may notify Apple, who may refund the purchase price; Apple has no further warranty obligation.
- Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
- You represent you are not located in a country subject to a U.S. Government embargo and not on any U.S. Government list of prohibited or restricted parties.
16. Changes
We may update these Terms. For material changes we will give at least 14 days' notice in-app or by email. Continued use after the change constitutes acceptance. The "Last updated" date at the top reflects the most recent revision.
17. General
These Terms, together with the Privacy Policy, EULA, and Community Guidelines, are the entire agreement between you and E1 Technology Inc. regarding the Service. If any provision is held unenforceable, the remainder will remain in effect. No waiver of any term is a continuing waiver. We may assign these Terms; you may not assign them without our consent.
